The text examines the judgment of the Court of Justice of December 3, 2018, in the Hein case, where the judges of Luxembourg out light some relevant elements of the right guaranteed to each worker to an annual leave, granted by art. 31 of the «Charter of fundamental rights of the European Union» and by art. 7 of Directive 2003/88/EU. In particular, the ruling of the Court consolidates the case law according to which the worker’s right to mature leave, is established in relation to the period of time actually worked by the employee. In addition the Court clarifies that the period of time actually worked does not affect the allowance for holidays to which the worker is entitled. In particular, the pay to be received during holidays must be equivalent to that received during the periods of actual work.
La nota esamina la sentenza della Corte di giustizia del 3 dicembre 2018, nel caso Hein, dove i giudici di Lussemburgo puntualizzano alcuni importanti elementi del diritto di ciascun lavoratore di usufruire di un periodo di ferie retribuito, garantito all’art. 31 della «Carta dei diritti fondamentali dell’Unione europea» e all’art. 7 della Direttiva 2003 /88/UE. In particolare la pronuncia della Corte da un lato consolida la giurisprudenza secondo la quale il diritto del lavoratore alle ferie matura prorata, cioè in relazione al periodo di tempo effettivamente lavorato dal dipendente e, dall’altro chiarisce che il periodo di tempo effettivamente lavorato non influisce sull’indennità per ferie cui ha diritto il lavoratore. In particolare la retribuzione da percepire nel periodo di ferie deve essere equivalente a quella percepita durante i periodi di lavoro effettivo.
